The rules of the network
Terms of Service
The rules for the TOXIC NETWORK website, app, memberships, creative-work tools and related services.
Current operator
TOXIC NETWORK UG (haftungsbeschränkt), Virchowstraße 16/3, 89075 Ulm, Germany · Amtsgericht Ulm · HRB 752661 · Managing Director: Lennard Anton Kaiser.
Portfolio import and profile assistance
Members may voluntarily authorize TOXIC to prepare, complete and maintain their professional portfolio. Assistance can include importing selected media, uploading, arranging, cropping, resizing, compressing, formatting, preparing carousels and displaying content on the member’s TOXIC profile. It is limited to specific sources supplied, selected or connected by the member and expressly authorized; public availability alone is not permission. Members confirm the necessary rights and permissions. Ownership remains with the applicable rights holder. The member grants TOXIC a non-exclusive, royalty-free licence limited to reproducing, storing, technically adapting and displaying the authorized portfolio content for the duration necessary to operate the member’s TOXIC profile. No unrelated advertising, resale, ownership transfer, agency, management or legal representation is authorized. Assistance can be disabled prospectively at any time in Edit Profile. Existing portfolio content remains under the member’s ordinary editing and deletion controls. TOXIC may refuse, restrict or remove content where rights are disputed, permissions cannot reasonably be verified, content is reported or it violates law or these Terms. Existing privacy, verification and moderation rules continue to apply.
Current operator
The website https://toxicnetwork.app, the TOXIC NETWORK app and related services are operated by TOXIC NETWORK UG (haftungsbeschränkt), UG (haftungsbeschränkt), Virchowstraße 16/3, 89075 Ulm, Germany, registered with Amtsgericht Ulm under HRB 752661. Managing Director: Lennard Anton Kaiser. Contact: office@toxicnetwork.app.
Website, app and services
The public website provides product, legal, support and safety information. The TOXIC NETWORK app provides professional profiles, portfolios, messaging, Jobs, Events, projects and other creative-industry collaboration tools. Some functions may require a TOXIC membership or a separately enabled payment workflow.
Waitlist and newsletter
Joining a waitlist or TOXIC INSIGHTS email list remains free and does not itself create a paid membership, booking, agency relationship or purchase. TOXIC INSIGHTS email subscriptions are managed by TOXIC NETWORK independently from the public Substack mirror. Digital memberships offered in the native iOS app are purchased separately through Apple In-App Purchase.
Marketing consent
TOXIC INSIGHTS uses a separate purpose-specific mailing list and double opt-in. Consent wording/version and timestamps are recorded so consent can be demonstrated. Marketing consent is optional, is separate from creating or using a TOXIC account, and can be withdrawn at any time through the personal unsubscribe link or by contacting TOXIC. Withdrawal is effective for future editorial marketing emails.
Memberships and payments
TOXIC WHITE is the free membership tier. Where available, TOXIC BLACK and TOXIC BUSINESS digital memberships and the BLACK Day Pass are purchased in the native iOS app only through Apple In-App Purchase; recurring Apple subscriptions are managed through the user’s Apple account. TOXIC NOW is a separate payment workflow only for professional creative services performed outside the app. Those service payments use Stripe card/Checkout processing and eligible recipients can use Stripe Connect for payouts. Stripe/TOXIC NOW is not used to sell or unlock digital TOXIC app functionality.
Free Launch / 0% TOXIC fee
During the current Free Launch, TOXIC charges 0% platform fee and 0% buyer fee for Direct Booking / TOXIC NOW and does not retain any part of the agreed creative-service amount as a TOXIC booking, platform or service fee. Unless TOXIC expressly identifies itself as the provider of a separate service, the underlying creative-service contract is directly between the Client and the Creative. The Creative remains responsible for any invoice required for their service and for their own tax, VAT, social-security and other professional obligations. TOXIC does not issue a TOXIC fee invoice where no TOXIC fee is charged. A 0% TOXIC fee does not mean the recipient necessarily receives the gross payment amount: Stripe processing charges, refunds, disputes, reversals and other provider adjustments may reduce or delay the amount available for payout. A first payout may also take longer while Stripe completes initial settlement or verification checks. A 0% TOXIC fee does not make user earnings tax-free and does not transfer either party's tax obligations to TOXIC. Before TOXIC activates a non-zero booking/platform fee, the relevant commercial, payment, tax and consumer information must be updated. Separate Apple memberships and separately disclosed managed-service or success-commission arrangements remain governed by their own terms.
Age
TOXIC NETWORK is intended for persons aged 18 or older.
Availability
Features may be changed, paused or unavailable because of maintenance, security, provider outages, store requirements or legal obligations. TOXIC does not guarantee uninterrupted availability or a professional outcome from another user. Nothing in these Terms limits rights or liability that cannot legally be limited.
Intellectual property
TOXIC NETWORK branding, website design and original content may be protected by copyright, trademark, design or unfair-competition law. Nothing on the website grants a licence to impersonate TOXIC NETWORK or reuse protected assets beyond what applicable law permits.
Governing law
German law applies to the service relationship with the Germany-based operator to the extent legally permitted. Mandatory consumer protections and mandatory jurisdiction rules remain unaffected.
Questions, withdrawal or cancellation?
Use the public withdrawal function or subscription cancellation function for direct TOXIC contracts where applicable. Apple subscriptions must be managed through Apple subscription settings. Marketing or newsletter consent can be withdrawn through the available unsubscribe route or by contacting office@toxicnetwork.app.
